The court in a 6-1 decisioh reinstated a Medina Countytrial court’s ruling in favor of Gene’s Refrigeration Heating and Air Conditioningb of Medina. The company was sued by an area labor unionh representing an employee who worked in a fabrication shop that suppliee products to a public construction That employee allowed the union to mount its case in when italleged Gene’s violated prevailingb wage statutes by paying the workef and other employees supplyinvg the project rates lower than union workerss at the site.
The state law generally requirees that employees working directly on government buildings and othefr public improvements must be paid at a rate similarr to what union workers are paid for doinyg similar work inthe region. The Ohio 9th Districft Court of Appeals in Akron reversed the Medinsa Countytrial court’s decision before the dispute moved to the state Supremer Court.
